| While we do ensure the best quality transfer of your film the final quality will be dependent on the current condition of the film. Due to the deterioration of film with the passage of time we offer no guarantees as to the quality of the final outcome. We cannot fix out of focus film or make any adjustment to camera work. Once work has begun there will be no refunds of any deposits.
With the submission of this order, the CLIENT has requested the services that have been contracted for and agrees to pay the above listed prices for said services. The CLIENT agrees that the liability of HBMEDIA SOLUTIONS, its agents, and/or employees, for any losses or damages of any kind or nature to the client?s materials be it tape record, photograph or any other medium, is limited to the costs of replacing such tape, record or other material . The client further agrees that HBMEDIA SOLUTIONS, its agents and/or employees, shall not otherwise be liable to the CLIENT for any loss or damage of any kind or nature, whether direct, incidental, consequential or otherwise. The CLIENT declares that all materials submitted by the CLIENT for transfer or other reproduction is not in violations of any copyright laws of the UNITED STATES OF AMERICA. The CLIENT will indemnify and hold HBMEDIA SOLUTIONS harmless with respect to any claim of violation of such laws. The materials submitted by the CLIENT were either created by or the CLIENT has permission of the copyright owner to duplicate those items. All copyrighted material must be accompanied by the appropriate written release form. HBMEDIA SOLUTIONS neither warrants nor guarantees that any reproduction from any source will be viable on all types of media devices (i.e., DVD players, computer drives, CD-ROMS, DVD-ROMS). The CLIENT must pay a minimum of a 50% deposit on all work done at the outset of the project and pay the remaining 50% due and owing before any finalized materials will be turned over by HBMEDIA SOUTIONS. Failure to pay will result in HBMEDIA SOLUTIONS asserting all legal rights and remedies under the Laws of the State of Florida and the United States of America, including but not limited all attorneys' fees and costs of any litigation. |
